释义

法律主观：

行政机关作出的行政处罚必须进行公开。行政处罚的原则之一就是公正、公开的原则。并且行政机关对违法行为给予行政处罚的法定依据必须公布；如果未经公布的，不得作为行政处罚的依据。

法律客观：

《公安机关办理行政案件程序规定》第一百六十八条对违法行为事实清楚，证据确实充分，依法应当予以行政处罚，因违法行为人逃跑等原因无法履行告知义务的，公安机关可以采取公告方式予以告知。自公告之日起七日内，违法嫌疑人未提出申辩的，可以依法作出行政处罚决定。
