公司出现问题变更合同怎么办

公司发生问题后合同需要变更的，应当及时通知合同的相对方，协商变更合同，如果双方无法就合同变更达成一致的，可以参照合同变更的相关规定，如果不属于法定情形也无法协商一致，违约方需要承担违约责任。双方取得一致意见的变更，具有与其他部分同等的法律效力。但是，合同变更生效以双方当事人意思表示一致为前提，这是合同意思自治原则的延伸。如果法律、行政法规规定变更合同需要办理批准、登记手续，当事双方当遵照执行。
