释义	医疗事故医调委调解不成怎么办调解无效，则应当向法院起诉。可以按照《医疗事故处理办法》规定，医疗纠纷的处理应首先由发生纠纷的医患双方遵照事实求是的原则协商处理。只有在协商无法进行发生争议时，才提请当地医疗事故技术鉴定委员会进行鉴定。此外，卫生行政部门也可在鉴定前与后对医患双方进行调解，调解必须建立在医患双方自愿的基础上，对于鉴定结论，医患双方任何一方对鉴定结论有异议，又调解无效的，可提请上一级医疗事故技术鉴定委员会进行。构成事故的，患方可凭鉴定结论向人民法院提起。
