释义	法律分析：担保合同是主合同的从合同，主合同无效，担保合同无效，担保合同另有约定的，按照约定执行。也就是说，如果主合同债权因主合同无效而不存在了，那么担保合同也就失去了担保的对象，担保合同将随主合同无效而失效。但是如果明确约定主合同效力不影响担保合同效力的，在主合同无效时，担保人应按照有效担保合同约定的条款承担担保责任。法律依据：《中华人民共和国民法典》第五百零六条合同中的下列免责条款无效：（一）造成对方人身损害的；（二）因故意或者重大过失造成对方财产损失的。
