释义	超期羁押是指依法被刑事拘留、逮捕的犯罪嫌疑人、被告人，在侦查、审查起诉、审判阶段的羁押时间超过刑事诉讼法规定的羁押时限的一种违法行为。因为不同阶段的法定期限均不尽相同，即只要超过期限后既不办理延期也不移送下一阶段就属于超期羁押，例如刑事拘留37天后既未批准逮捕也未取保候审、批捕后2个月既未移送检察院审查起诉，也未延长逮捕期限等，这些都是属于超期羁押的行为。法律依据:《中华人民共和国刑事诉讼法》第一百五十六条规定：《公安机关办理刑事案件程序规定》第一百四十四条
