释义	法律分析: 离婚时，还未取得产权的房屋，人民法院一般不会进行分割，只会决定房屋的使用权。等到产权下来以后，双方可以协商分割，如果协商失败的话，可以另行提起诉讼。法律依据:《最高人民法院关于适用婚姻家庭编的解释（一）》第七十七条离婚时双方对尚未取得所有权或者尚未取得完全所有权的房屋有争议且协商不成的，人民法院不宜判决房屋所有权的归属，应当根据实际情况判决由当事人使用。当事人就前款规定的房屋取得完全所有权后，有争议的，可以另行向人民法院提起诉讼。
