释义	当事人在合同中对履行地点、交货地点未作约定或约定不明确的，或者虽有约定但未实际交付货物，且当事人双方住所地均不在合同约定的履行地，以及口头购销合同纠纷案件，均不依履行地确定案件管辖。照我国法律规定，合同双方当事人可以在合同中约定，发生纠纷时由哪个法院管辖；并且此种约定管辖优先于一般管辖。【法律依据】《民事诉讼法》第二十五条，合同的双方当事人可以在书面合同中协议选择被告住所地、合同履行地、合同签订地、原告住所地、标的物所在地人民法院管辖，但不得违反本法对级别管辖和专属管辖的规定。
