交通肇事逃逸属于刑事犯罪吗
释义
交通肇事逃逸不一定都是犯罪，如果没有造成人员伤亡或者重大财产损失就不构成犯罪。交通肇事逃逸是指机动车驾驶员在发生交通事故的同时，擅自逃离事故现场，使交通事故所引起的民事、刑事、行政责任无法确定，其目的在于推卸、逃脱责任的行为。交通肇事犯罪案件，犯罪后逃逸的，处三年以上七年以下有期徒刑;因逃逸致人死亡的，处七年以上有期徒刑。
