释义	法律分析: 在公诉刑事案件中，由检察院承担举证责任；在自诉刑事案件中，原告人即自诉人承担举证责任。被告人既没有义务向法庭证明自己有罪，也没有义务向法庭证明自己无罪。《刑事诉讼法》第五十一条公诉案件中被告人有罪的举证责任由人民检察院承担，自诉案件中被告人有罪的举证责任由自诉人承担。第四十一条辩护人认为在侦查、审查起诉期间公安机关、人民检察院收集的证明犯罪嫌疑人、被告人无罪或者罪轻的证据材料未提交的，有权申请人民检察院、人民法院调取。
