释义	1、前罪和后罪必须均为危害国家安全罪。如果行为人实施的前后两罪都不是危害国家安全罪，或者其中之一不是危害国家安全罪，就不能构成危害国家安全罪的特别累犯。当然，这并不排除其构成一般累犯的可能。2、前罪被判处的刑罚和后罪应判处的刑罚的种类及其轻重不受限制。即使前后两罪或者其中一罪判处管制、拘役甚至单处附加刑，也不影响危害国家安全罪特别累犯的构成。3、后罪可以发生在前罪刑罚执行完毕或者赦免后的任何时候，不受两罪相隔时间长短的限制。
