释义	《婚姻登记条例》第十条第二款：“中国公民同外国人在中国内地自愿离婚的，内地居民同香港居民、澳门居民、台湾居民、华侨在中国内地自愿离婚的，男女双方应当共同到内地居民常住户口所在地的婚姻登记机关办理离婚登记。”协议离婚的效力：1、当事人从取得离婚证之日起，婚姻关系即为解除，双方均可与他人结婚2、离婚协议不具有法律强制执行力，如果因履行离婚协议产生争议，必须向法院提起诉讼。
