释义	在服刑或接受劳动教养的人能否结婚，法律没有明确规定。但根据有关司法解释的精神，正在服刑期间的人因为丧失了人身自由，无法亲自实施结婚这一法律行为，而结婚行为因具有人身属性不能由他人代理，所以不能结婚。此外，因病被保外就医的服刑人员，虽有暂时的人身自由，也不能结婚。但人民法院决定缓刑、假释的人，可以结婚。正在接受劳动教养的人，根据有关规定，可以结婚，但必须持有劳动教养管理部门出具的结婚登记准假证明，才可申请结婚登记。
