释义	夫妻关系的解除，必须本人办理。离婚有两种方式，一种是协议离婚，一种是诉讼离婚，通常来说只有协议离婚会发放离婚证，诉讼离婚是只给判决书或者调解书的。而法律明确规定，若双方想办理离婚手续的话，必须双方本人到民政局签署离婚协议，由民政局确认无误后，发放离婚证。《婚姻登记管理条例》第三十一条【自愿离婚男女双方自愿离婚的，准予离婚。双方必须到婚姻登记机关申请离婚。婚姻登记机关查明双方确实是自愿并对子女和财产问题已有适当处理时，发给离婚证。
