释义	聚众斗殴罪的主体是，凡年满16周岁且具备刑事责任能力的自然人均能构成聚众斗殴罪。但并非所有参加聚众斗殴者均构成聚众斗殴罪。只有聚众斗殴的首要分子和其他积极参加者，才能构成聚众斗殴罪主体。所谓首要分子，是指在聚众斗殴中起组织、策划、指挥作用的犯罪分子；所谓其他积极参加者，是指除首要分子以外的在聚众斗殴中起重要作用的犯罪分子。对于一般参加者，只能依治安管理处罚条例追究行政责任，不能构成聚众斗殴罪主体。已满十四周岁不满十八周岁的人犯罪，应当从轻或者减轻处罚。
