释义	根据《刑法》第239条的规定，有下列情形之一的，应当立案：（1）以勒索财物为目的绑架他人的；（2）绑架他人作为人质的；（3）以勒索财物为目的偷盗婴幼儿的。绑架罪是行为犯，行为人只要实施了上述三种情形之一的行为，就应当立案侦查。法律依据《中华人民共和国刑法》第二百三十九条
