使用假钞100元该如何量刑
释义
使用假币100元一般以行政处罚为主。购买伪造、变造的人民币或者明知是伪造、变造的人民币而持有、使用，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，由公安机关处十五日以下拘留、一万元以下罚款。
法律依据
《刑法》第一百七十二条，明知是伪造的货币而持有、使用，数额较大的，处三年以下有期徒刑或者拘役，并处或者单处一万元以上十万元以下罚金；数额巨大的，处三年以上十年以下有期徒刑，并处二万元以上二十万元以下罚金；数额特别巨大的，处十年以上有期徒刑，并处五万元以上五十万元以下罚金或者没收财产。
