未成年打架要怎样处理 |

人与人之间发生矛盾是很正常的一件事，不能一言不合就动手打架，尤其是未成年人。那么未成年人打架怎么处理?对于年满十四周岁未满十六周岁的未成年人打架，没有造成严重后果的，按一般治安案件处理。达到严重后果的，追究刑事责任。严重后果包括以下八种情形：犯故意杀人，故意伤害致人重伤或死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投放危险物质的。第二、对于年满十六周岁，负刑事责任的年龄，如果打架情节不严重，仍旧按照治安案件处理。如果构成故意伤害、聚众斗殴、寻衅滋事，可以按照该罪名定罪量刑。应注意：为了保护未成年人，刑事诉讼法实行对犯罪的未成年人实行教育、感化、挽救的方针，坚持教育为主、惩罚为辅的原则，犯罪的时候不满十八周岁，被判处五年有期徒刑以下刑罚的，应当对相关犯罪记录予以封存。法律依据：《中华人民共和国刑法》第十七条【刑事责任年龄】已满十六周岁的人犯罪，应当负刑事责任。已满十四周岁不满十六周岁的人，犯故意杀人、故意伤害致人重伤或者死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投放危险物质罪的，应当负刑事责任。已满十四周岁不满十八周岁的人犯罪，应当从轻或者减轻处罚。因不满十六周岁不予刑事处罚的，责令他的家长或者监护人加以管教;在必要的时候，也可以由政府收容教养。
