社保是否属于仲裁范围是要分情况而定的：1、因用人单位未参加社会保险，劳动者向用人单位追索相关保险待遇，而发生的争议。如追索工伤保险待遇、生育保险待遇、失业保险待遇、报销医疗费用或劳动者退休后，与尚未参加社会保险统筹的原用人单位因追索养老金、医疗费、工伤保险待遇和其他社会保险费而发生的纠纷，属于劳动仲裁和人民法院的受案范围。2、用人单位未为劳动者缴纳社会保险，要求用人单位为其缴纳社会保险的。该类案件既不属于劳动仲裁的受案范围，也不属于人民法院的受案范围。3、用人单位已经为劳动者缴纳社会保险参保手续，但劳动者认为用人单位缴纳社会保险费不足而引起争议的，也不属于劳动仲裁的受案范围。劳动者对第二、三类社保争议有异议的，可以依法向社保稽查部门举报，通过行政手段处理。《中华人民共和国劳动争议调解仲裁法》第二条中华人民共和国境内的用人单位与劳动者发生的下列劳动争议，适用本法：(一)因确认劳动关系发生的争议(二)因订立、履行、变更、解除和终止劳动合同发生的争议(三)因除名、辞退和辞职、离职发生的争议(四)因工作时间、休息休假、社会保险、福利、培训以及劳动保护发生的争议(五)因劳动报酬、工伤医疗费、经济补偿或者赔偿金等发生的争议(六)法律、法规规定的其他劳动争议。
