释义	法律分析：公司有官司能破产。法院判断公司能够破产清算的事实依据是公司有无能力清偿到期债务，与公司有无涉诉没有关系。在公司提起诉讼的时候，如果人民法院已受理破产申请，那么原来的诉讼案件需要暂时中止审理。法律依据：《中华人民共和国企业破产法》第二条企业法人不能清偿到期债务，并且资产不足以清偿全部债务或者明显缺乏清偿能力的，依照本法规定清理债务。企业法人有前款规定情形，或者有明显丧失清偿能力可能的，可以依照本法规定进行重整。
