法律分析：
先诉抗辩权亦称检索抗辩权，是指保证人在债权人未就主债务人的财产强制执行而无效果之前，可以拒绝债权人要求其履行保证债务的权利。先诉抗辩权是保证人依其地位可以享有的特殊权利，这种权利的行使可以达到延期履行保证债务的结果，因此其性质为一种延期履行的抗辩权。
法律依据：
《中华人民共和国民法典》 第六百九十三条 一般保证的债权人未在保证期间对债务人提起诉讼或者申请仲裁的，保证人不再承担保证责任。
