如果离婚一方失业无法支付抚养费，应该如何处理？ |

离婚后，父母需要按照实际需要、负担能力以及生活水平确定子女抚育费。对方无固定收入的，可依据当年总收入或同行业平均收入支付20%至30%的抚育费。即使感情破裂，失去抚养权的一方也需要遵守协议支付抚育费，即使失业也需要支付。1、可以向法院起诉请求对方支付子女抚育费。抚育费的数额应根据子女的实际需要、父母双方的负担能力和当地的实际生活水平确定。如果对方无固定收入，则抚育费的数额可依据当年总收入或同行业平均收入，按百分之二十至三十的比例给付。
2、抚养孩子是父母的义务，即使是因感情破裂，没有抚养权的一方也需要按照离婚协议的规定按期足额地支付抚养费。但在生活中，存在一方已经失业且没有能力支付抚养费的情况，此时仍需要支付抚养费。《民法典》一千零八十五条【离婚后子女抚养费的负担】离婚后，子女由一方直接抚养的，另一方应当负担部分或者全部抚养费。
负担费用的多少和期限的长短，由双方协议；
协议不成的，由人民法院判决。
前款规定的协议或者判决，不妨碍子女在必要时向父母任何一方提出超过协议或者判决原定数额的合理要求。
