问题	浅析共同犯罪中刑事责任的认定
释义	对共同犯罪人进行正确的分类，是确定共同犯罪人刑事责任的前提，因为我国刑法贯彻罪责自负原则，而不承认团体责任。关于共同犯罪人的分类问题，从国外立法和司法实践看，基本存在两种：1、是按共同犯罪人行为的性质和活动分工的特点来分类。2、是根据犯罪分子在共同犯罪中所起的作用来分类。我国刑法采用折中分类法，即以共同犯罪人在共同犯罪中的地位和作用为主，并适当考虑共同犯罪人的分工情况，将共同犯罪人分为主犯、从犯、胁从犯和教唆犯。
