释义	法律分析：劳动者可以选择用人单位所在地或本人居住地的职业病诊断机构进行诊断。本办法所称居住地是指劳动者的经常居住地。四、一旦鉴定为职业病，应向企业提出工伤保险费用和赔偿，或向劳动部门提起仲裁，或向法院提起民事诉讼，有权向用人单位提出医疗费、工伤保险待遇和赔偿要求。法律依据：《工伤保险条例》第十七条按照职业病防治法规定被诊断、鉴定为职业病，所在单位自被诊断、鉴定为职业病之日起30日内，向劳动保障部门提出工伤认定申请。
