公司清算是公司破产吗？

法律分析：
公司清算不一定就是破产。清算有破产清算，也有因公司解散、被依法责令关闭等的清算。所以只有不能清偿到期债务，并且资产不足以清偿全部债务或者明显缺乏清偿能力的企业法人的清算，才是破产清算。
法律依据：
《中华人民共和国企业破产法》
第二条 企业法人不能清偿到期债务，并且资产不足以清偿全部债务或者明显缺乏清偿能力的，依照本法规定清理债务。企业法人有前款规定情形，或者有明显丧失清偿能力可能的，可以依照本法规定进行重整。
第三条 破产案件由债务人住所地人民法院管辖。
