释义	不包括。按照相关法律法规的的规定：按比例安排就业的残疾职工，是指符合法定的就业年龄，并与用人单位存在劳动关系(包括事实劳动关系)、各种用工期限的残疾人，不包括离退休返聘人员。因此，用人单位聘用、留用已办理离退休手续的人员(包括留用本单位或聘用外单位的离退休人员)，不统计在“在职职工”范围内。聘用退休人员在聘用期间发生工伤的处理，各地做法不完全一致。
