释义	缓刑是指人民法院对被判处拘役、三年以下有期徒刑的犯罪分子，根据其犯罪情节和认罪、悔罪表现，认为原判刑罚可以暂缓执行，规定一定期限的考验期，在考验期内没有发生法定的撤销缓刑的情形、原判刑期不再执行的一种刑罚执行制度。【法律依据】《刑法》第七十三条，拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于二个月。有期徒刑的缓刑考验期限为原判刑期以上五年以下，但是不能少于一年。缓刑考验期限，从判决确定之日起计算。
