释义	法律分析: 开发商垫付购房首付不可信。被司法机关认定为以合法形式掩盖非法目的的无效行为的，一旦认定为无效的则合同自始无效，开发商应返还购房款、购房者退房；被银行认定为恶意串通损害第三人利益的无效行为的，如后期购房者未能按期偿付按揭贷款，银行可以起诉开发商，要求开发商因开具虚假证明承担连带清偿责任。法律依据: 《中华人民共和国民法典》第一百四十六条行为人与相对人以虚假的意思表示实施的民事法律行为无效。以虚假的意思表示隐藏的民事法律行为的效力，依照有关法律规定处理。
