释义	拘役要开庭审理吗属于刑事案件，需开庭审理。拘役是指短期剥夺罪犯人身自由，就近拘禁并强制劳动的刑罚。在中国是主刑之一，拘禁的期限为1个月以上6个月以下，数罪并罚时最高不能超过1年。拘役有如下特点： (1)刑期短于有期徒刑，由公安机关就近执行。 (2)服刑期间，被处拘役者每月可回家1~2天，参加劳动者还可酌量发给报酬。 (3)拘役期满后再犯罪，不构成累犯。拘役的刑期，从判决执行之日起计算;判决前先行羁押的，羁押1日折抵刑期1日。
