释义	法律分析：无效合同被认为自始没有法律约束力、自始无效，因该合同而获得的财产应当予以返还，不能返还或者没有必要返还的，应当折价补偿。因当事人双方恶意串通，损害国家、集体或第三人利益而无效的合同，当事人因此取得的财产应当归还国家，返还集体或第三人。法律依据：《中华人民共和国民法典》第五百零七条合同不生效、无效、被撤销或者终止的，不影响合同中有关解决争议方法的条款的效力。第五百零八条本编对合同的效力没有规定的，适用本法第一编第六章的有关规定。
