释义	新的《中华人民共和国劳动合同法》《劳动法》都没有明确规定其配偶的陪产假。规定其丈夫享受陪产假的，应该是当地的《计划生育条例》。一般法律规定生育子女的夫妻，男方享受十五天的陪产假，在规定假期内照发工资，不影响福利待遇和全勤、评奖。法律依据：比如《山东省人口与计划生育条例》第三十条：男女双方晚婚的，除国家规定的婚假外，增加婚假十四日。女方晚育的，除国家规定的产假外，增加产假六十日，并给予男方护理假七日。增加的婚假、产假、护理假，视为出勤，工资照发，福利待遇不变。
