释义	法律分析: 针对专利申请提出无效宣告请求的，国务院专利行政部门会对无效的请求应当及时审查和作出决定，并通知请求人和专利权人。对国务院专利行政部门宣告专利权无效或者维持专利权的决定不服的，可以自收到通知之日起三个月内向人民法院起诉。《中华人民共和国专利法》第四十五条自国务院专利行政部门公告授予专利权之日起，任何单位或者个人认为该专利权的授予不符合本法有关规定的，可以请求国务院专利行政部门宣告该专利权无效。
