违约合同法律怎么样写 |

没有写违约责任的合同有没有效，要依据合同的具体内容而定，如果只是没有违约责任，合同的其他方面合法的，该合同是有效的。只要双方订立的合同是合法有效的，就受法律保护。《中华人民共和国合同法》第一百零七条规定：当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。这就是法律对违约方采取的强制制裁措施。(1) 继续履行。指合同义务没有履行或者履行不符合约定的，守约方可以要求违约方按照合同约定继续履行，直至达到合同目的。(2)采取补救措施。指履行债务的标的物品质不符合合同约定的条件，在不需继续履行而只需采取适当补救措施时，即可达到合同目的或守约方认为满意的目的。(3)赔偿金。指合同各方在合同中约定的，一方因违约给对方造成实际损害的，按实际损害数额给予赔偿的责任承担方式。《中华人民共和国合同法》第一百零七条【违约责任】当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
