单位合法安排加班依据《劳动合同法》第三十一条规定:用人单位应当严格执行劳动定额标准,不得强迫或者变相强迫劳动者加班。用人单位安排加班的,应当按照国家有关规定向劳动者支付加班费。根据以上规定,用人单位安排劳动者加班必须符合以下几个条件:1、首先用人单位必须与劳动者及工行协商一致,征得劳动者及工行同意;2、必须是由于单位生产经营的需要;3、安排加班,一般一天不得超过1小时,特殊情况不得超过3小时,但一个月不得超过36小时。
