释义	协议离婚指婚姻关系因双方当事人的合意而解除的离婚方式。具备的条件有：(一)双方当事人系合法登记的夫妻;(二)双方当事人离婚是完全自愿的;(三)双方当事人对子女抚养、财产和债务处理等事项达成协议;(四)一方或双方当事人的户口是本辖区内的常住户口;(五)申请离婚登记的双方当事人必须同时到一方常住户口所在地的婚姻登记机关申请，不得委托他人代理。以上几点，如果有任何一点达不成协议，就只能通过诉讼方式离婚。法律依据《婚姻登记条例》第十一条、第三十一条
