2. 《工伤保险条例》第四十二条：“用人单位收到工伤申报书后，应当及时组织组织事故处理，确定工伤认定情况，并通知申请人。劳动者或者其近亲属认为劳动者的原因或者第三人的事由造成的损害应当认定为工伤的，可以向事故处理机构申请工伤认定。”
3. 《工伤保险条例》第四十四条：“已确认为工伤的，由用人单位按照下列规定向受害者支付医疗费、护理费、住院伙食费和交通费等：(一)治疗工伤期间，支付日工资或者工资平均值的百分之九十；(二)治疗工伤期间因事假或者病假未实行或者实行不完全的，按照规定支付基本工资或者生活补助费。”
因此，申请人在工伤申请时限过期后，可以通过提供充分的其他证据来获得伤残补助金。
