释义	强奸罪胁从犯的认定标准：胁从犯的本质特征在于参加共同犯罪是违背其意志的，也就是说其本身没有犯罪的故意，其参加犯罪是在他人的精神强制比如威胁、揭发隐私等情形下不自愿的作出的。以下几种情景下不宜认定为胁从犯1、行为人身体受外力强制完全失去意志自由的情况下的行为，其行为不能表达其主观意志，不可能具有罪过，不构成犯罪，也就无胁从犯之说；2、对于先是被迫参加，而后来变被动为主动，积极实施犯罪的，不宜定胁从犯；3、被诱骗参加共同犯罪的人，不宜定胁从犯。
