释义	二手房合同无效的，违约条款也无效。合同无效、被撤销或者终止的，不影响合同中独立存在的有关解决争议方法的条款的效力。但是，违约金条款不属于解决争议的条款，争议解决条款是指合同中约定的，如果双方发生争议，是选择仲裁还是诉讼等条款。因此，如果合同无效，违约金条款也无效。【法律依据】《民法典》第一百五十五条，无效的或者被撤销的民事法律行为自始没有法律约束力。《民法典》第一百五十六条，民事法律行为部分无效，不影响其他部分效力的，其他部分仍然有效。
