我国刑法对劫持汽车罪既遂的处罚规定
释义
法律分析：以暴力、胁迫或者其他方法劫持船只、汽车的，处五年以上十年以下有期徒刑;造成严重后果的，处十年以上有期徒刑或者无期徒刑。法院量刑会综合考虑犯罪动机、主观恶性、社会危害性、是否累犯、有无自首、立功等从轻减轻情节，以及当事人的认罪态度等因素确定。
法律依据：《中华人民共和国刑法》 第一百二十二条 以暴力、胁迫或者其他方法劫持船只、汽车的，处五年以上十年以下有期徒刑;造成严重后果的，处十年以上有期徒刑或者无期徒刑。
