释义	民事撤诉后随时可以再起诉。一般情况下，民事诉讼撤诉后当事人以同一诉讼请求再次起诉的法院应予受理，随时可以再起诉，离婚案件除外，离婚案件在撤诉的六个月之内没有新的理由和情况法院不会受理。【本文关联的相关法律依据】《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第二百一十四条原告撤诉或者人民法院按撤诉处理后，原告以同一诉讼请求再次起诉的，人民法院应予受理。原告撤诉或者按撤诉处理的离婚案件，没有新情况、新理由，六个月内又起诉的，比照民事诉讼法第一百二十四条第七项的规定不予受理。
