法律分析：醉驾驾驶证必须吊销。醉酒驾驶机动车辆，吊销驾照，5年内不得重新获取驾照，经过判决后处以拘役，并处罚金。
法律依据：《中华人民共和国道路交通安全法》
第二十四条 公安机关交通管理部门对机动车驾驶人违反道路交通安全法律、法规的行为，除依法给予行政处罚外，实行累积记分制度。公安机关交通管理部门对累积记分达到规定分值的机动车驾驶人，扣留机动车驾驶证，对其进行道路交通安全法律、法规教育，重新考试；考试合格的，发还其机动车驾驶证。
第九十一条 饮酒后驾驶机动车的，处暂扣6个月机动车驾驶证，并处1000元以上2000元以下罚款。因饮酒后驾驶机动车被处罚，再次饮酒后驾驶机动车的，处10日以下拘留，并处1000元以上2000元以下罚款，吊销机动车驾驶证。醉酒驾驶机动车的，由公安机关交通管理部门约束至酒醒，吊销机动车驾驶证，依法追究刑事责任；5年内不得重新取得机动车驾驶证。
饮酒后驾驶营运机动车的，处15日拘留，并处5000元罚款，吊销机动车驾驶证，5年内不得重新取得机动车驾驶证。
醉酒驾驶营运机动车的，由公安机关交通管理部门约束至酒醒，吊销机动车驾驶证，依法追究刑事责任；10年内不得重新取得机动车驾驶证，重新取得机动车驾驶证后，不得驾驶营运机动车。
饮酒后或者醉酒驾驶机动车发生重大交通事故，构成犯罪的，依法追究刑事责任，并由公安机关交通管理部门吊销机动车驾驶证，终生不得重新取得机动车驾驶证。
第一百一十条 执行职务的交通警察认为应当对道路交通违法行为人给予暂扣或者吊销机动车驾驶证处罚的，可以先予扣留机动车驾驶证，并在24小时内将案件移交公安机关交通管理部门处理。
道路交通违法行为人应当在15日内到公安机关交通管理部门接受处理。无正当理由逾期未接受处理的，吊销机动车驾驶证。
公安机关交通管理部门暂扣或者吊销机动车驾驶证的，应当出具行政处罚决定书。
