释义	同时履行抗辩权，是指双务合同的当事人应同时履行义务的，一方在对方未履行前，有权拒绝对方请求自己履行合同的权利。同时履行抗辩权的适用条件为：（1）由同一双务合同产生的互负债务，且双方债务有对价关系。（2）债务同时到期，可以同时履行；双方的对等给付是可能履行的义务。（3）当事人一方的履行不符合约定，即瑕疵履行的另一方可对有瑕疵的履行部分行使抗辩权。《合同法》第六十六条规定：当事人互负债务，没有先后履行顺序的，应当同时履行。一方在对方履行之前有权拒绝其履行要求。
