释义	法律分析：案发前退赃不算中止。犯罪形态分为预备、中止、未遂、既遂，这些形态是不会倒退的，中止是指在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的情形。当行为人实施了某种犯罪行为既遂的，就不会再恢复到之前中止的状态，就算案发前退赃也构成犯罪既遂。法律依据：《中华人民共和国刑法》第二十四条【犯罪中止】在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的，是犯罪中止。对于中止犯，没有造成损害的，应当免除处罚；造成损害的，应当减轻处罚。
