释义	法律分析：我国法律对一审判决生效很明确，自判决送达之日起，15日内为上诉期，过15日未上诉的判决就生效。而二审判决作为终审判决，并没有上诉期，二审判决何时算生效没有明文。只在民诉法中规定。法律依据：《中华人民共和国民事诉讼法》第一百七十六条人民法院审理对判决的上诉案件，应当在第二审立案之日起三个月内审结。有特殊情况需要延长的，由本院院长批准。人民法院审理对裁定的上诉案件，应当在第二审立案之日起三十日内作出终审裁定。
