释义	法律分析：我国的刑法对重婚罪的量刑标准作出了明确的规定。一般情况下，重婚罪中的小三也会被判刑。如果小三和当事人的丈夫一直都是以夫妻的名义来共同生活的话，不论小三有没有孩子，都触犯了刑法，当事人的丈夫和小三都要按照重婚罪来定罪。如果小三和当事人的丈夫只是婚外的非法同居而已，那么两个人都没有触犯法律，只是违反了伦理道德。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
