释义	根据我国《刑法》第196条第二款及《最高人民法院关于审理诈骗案件具体应用法律的若干问题的解释》规定，信用卡持有人以非法占有为目的，超过规定限额或者期限透支5000元以上，自收到发卡银行催收通知之日起3个月内仍不归还的，属于恶意透支并构成信用卡诈骗罪。但如果行为人未经催收自动归还或者在催收后归还透支款项的，构成不当透支，不以犯罪论处，承担相应民事责任。
