洗钱罪最高量刑是什么 应该怎么认定洗钱罪？ |
| 释义 |
洗钱罪，最高量刑是情节严重的，处五年以上十年以下有期徒刑，并处洗钱数额百分之五以上，百分之二十以下罚金。认定洗钱罪的方式是：
1.犯罪主体是一般主体，包括年满十六周岁、具有刑事责任能力的自然人；
2.行为对象为毒品犯罪、黑社会性质的组织犯罪、恐怖活动犯罪、走私犯罪、贪污贿赂犯罪、破坏金融管理秩序犯罪、金融诈骗犯罪的违法所得及其收益；
3.侵犯的是复杂客体，既侵空卖犯了金融秩序，又斗槐逗侵犯了社会经济管理秩序，还侵犯了国家正常的金融管理活动，及外汇管理的相关规定。

《中华人民共和国刑法》 第百九十一条 明知是毒品犯罪、黑社会性质的组织犯罪、恐怖活动犯罪、走私犯罪、贪污贿赂犯罪、破坏金融管理秩序犯罪、金融诈骗犯罪的所得，及其产生的收益，为掩饰、隐瞒其来源和性质，没收实施以上犯罪的所得及其产生的收益，处五年以下有期徒刑或者拘役，并处或者单处洗钱数额百分之五以上，百分之二十以下罚金明尘；情节严重的，处五年以上十年以下有期徒刑，并处洗钱数额百分之五以上，百分之二十以下罚金。
