释义	法律分析：防御商标是同一商标所有人在非同种商品上注册同一个著名商标，以防止他人使用著名商标，造成不良影响的商标。防御商标注册以后不一定使用，因此一般不易被批准注册。法律依据：《中华人民共和国商标法》第九条申请注册的商标，应当有显著特征，便于识别，并不得与他人在先取得的合法权利相冲突。商标注册人有权标明“注册商标”或者注册标记。
