重婚是告诉才处理吗 |

法律主观：
重婚案不一定是告诉才处理的案件，重婚案件一般由被害人自诉，如果情节比较严重，影响很坏的，即使被害人不起诉，而由人民群众、社会团体或有关部门提出控告，应由人民检察机关审查决定是否构成 重婚罪 。如需要追究刑事责任，向人民法院提起 公诉 。我国 刑法 第二百五十八条规定：有配偶而重婚的，或者明知他人有配偶而与之 结婚 的，处二年以下 有期徒刑 或者 拘役 。 告诉才处理的案件是 自诉案件 的一种，由人民法院直接受理。告诉才处理的案件有： 1、《刑法》第145条规定：以暴力或者其他方法，包括用“大字报”、“小字报”公然侮辱他人或者捏造事实诽谤他人，情节严重的(但严重危害社会秩序和国家利益的除外); 2、《刑法》第179条规定，以暴力干涉他人婚姻自由(但引起被害人死亡的除外); 3、《刑法》第182条规定，虐待家庭成员，情节恶劣的(但引起被害人重伤、死亡的除外)。
