法律主观：

公司没有注销的，如果自行停业连续6个月以上的，可以由公司登记机关吊销其营业执照。对于不按规定办理注销手续的公司，工商局还可以视情况将其列入经营异常名录。

法律客观：

《公司法》第二百一十一条公司成立后无正当理由超过六个月未开业的，或者开业后自行停业连续六个月以上的，可以由公司登记机关吊销营业执照。公司登记事项发生变更时，未依照本法规定办理有关变更登记的，由公司登记机关责令限期登记；逾期不登记的，处以一万元以上十万元以下的罚款。
