园地可以申请建厂房吗 |

一般农用地是可以用来建厂房的，但前提是必须经过审批。农业用地是直接或间接为农业生产所利用的土地。又称农用地。包括耕地、园地、林地、牧草地、养殖水面、坑塘水面、农田水利设施用地，以及田间道路和其他一切农业生产性建筑物，占用的土地等。
农村建设用地在有批准文件时，可以自由建设厂房，但同时还要具备农用地转让手续。没有的话去申请，否则即使占用了也会被依法收回。
我国法律规定严格控制，农用耕地改为非耕地，占用农村土地单位必须经过相关程序审批手续，没有经过审批是禁止私自改变土地原有用途。建设占用土地，涉及农用地转为建设用地的，应当办理农用地转用审批手续，以出让等有偿使用方式，取得国有土地使用权的建设单位。

《中华人民共和国土地管理法》
第四十四条 建设占用土地，涉及农用地转为建设用地的，应当办理农用地转用审批手续。永久基本农田转为建设用地的，由国务院批准。在土地利用总体规划确定的城市和村庄、集镇建设用地规模范围内，为实施该规划而将永久基本农田以外的农用地转为建设用地的，按土地利用年度计划分批次按照国务院规定由原批准土地利用总体规划的机关或者其授权的机关批准。
在已批准的农用地转用范围内，具体建设项目用地可以由市、县人民政府批准。在土地利用总体规划确定的城市和村庄、集镇建设用地规模范围外，将永久基本农田以外的农用地转为建设用地的，由国务院或者国务院授权的省、自治区、直辖市人民政府批准。
